Terms of service

1. Who these terms cover

These terms are an agreement between you and PayClear Health, Inc., a Delaware corporation, and they govern the payclear.health website and free accounts, including physician accounts. If your organization has signed a Master Services Agreement or Order Form with PayClear, that signed agreement controls for your organization's use wherever it differs from these terms. By using the site or creating an account you accept these terms.

2. The service

PayClear builds and maintains a record of reportable industry payments from public federal data and from what you enter and confirm, and produces reports and workflows around that record. The physician side of the product is free.

PayClear is software. It does not hold, transmit, or settle funds between any parties, and it takes no part of any payment owed to a physician.

3. Your account

Keep your information accurate and your credentials to yourself; accounts are per person. You are responsible for activity under your login. Tell us immediately at michael@payclear.health if you believe your account has been compromised.

4. Acceptable use

Do not attempt to access records that are not yours, probe or overload the service, misrepresent who you are, scrape the service, or use it for anything unlawful. We may suspend accounts that do.

5. Your content and our service

You keep all rights to the information you submit. You give us the license needed to operate the service on it: to store it, process it, and show it to the people you choose to share it with, and to no one else. Records derived from public federal sources remain public records. PayClear keeps all rights in the service itself.

6. What the service is not

PayClear provides records and workflow. It is not legal, tax, or compliance advice, and it does not discharge any reporting or disclosure duty you carry. You remain responsible for your own filings, disclosures, and regulatory obligations.

7. Disclaimer and limits

The service is provided "as is" without warranties of any kind, express or implied. Public-record data reflects what the government publishes, including its errors. To the extent the law allows, PayClear is not liable for indirect, incidental, special, consequential, or punitive damages; for free accounts, our total liability is capped at one hundred US dollars. Nothing here limits liability that cannot be limited by law.

8. Ending an account

You can close your account at any time. We can suspend or close accounts that violate these terms. Data handling on closure is described in the privacy policy.

9. Changes, law, contact

We may update these terms; the effective date above moves when we do, and material changes will be announced to account holders. Delaware law governs, excluding its conflict of laws rules. Questions reach michael@payclear.health.
